Jennifer Aniston’s alleged stalker, Jimmy Wayne Carwyle, has been declared mentally unfit to appear in trial.

On Thursday, the Friends star was not in attendance to hear psychiatrist Dr. Phani Tumu declare Carwyle as “currently incompetent to stand trial.”

However, Deputy Public Defender Robert Krauss told Los Angeles County Superior Court Judge, Maria Cavalluzzi the stalker, who is accused of running his car into the front gate of Jennifer’s home in Bel Air, was getting a “second opinion.”

With another hearing taking place next week, the judge has appointed second psychiatrist, Dr. Kory Knapke, to examine Carwyle.

He is charged with one felony count of stalking and another one of vandalism, along with an aggravating circumstance of being a potential cause to great bodily harm.

Carwyle is in custody since May 5, when the incident at Jennifer’s home occurred.

He is also accused of harassing the Morning Show actress by sending “unwanted social media, voicemail and email messages,” since March 2023.

Although Jennifer was home at the time of the incident, she didn’t come into contact with anyone and as per a public information officer from the Los Angeles Police Department, they told PEOPLE, “There was a security guard on premises who was able to detain that suspect until officers arrived, at which time they took him into custody without incident. The resident (Jennifer Aniston) was home at the time.”
